Terms of Service

By accessing or using the Bhojone platform ("Service"), including our website at bhojone.com, mobile applications, and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Bhojone ("Company," "we," "us," or "our"). You must be at least 18 years of age or the legal age of majority in your jurisdiction to use our Service.

By creating an account, subscribing to a plan, or using any part of the Service, you represent that you have the authority to enter into these Terms on behalf of yourself or the business entity you represent.

Bhojone is an all-in-one restaurant operating system designed for restaurants, cafes, cloud kitchens, and food-service businesses in India. The platform provides:

We may update, modify, or discontinue certain features of the Service at any time. We will make reasonable efforts to notify users of significant changes through email or in-app notifications.

To access the Service, you must create a Bhojone account. You are responsible for:

• Providing accurate, current, and complete registration information, including your business name, contact details, and applicable GSTIN.
• Maintaining the confidentiality and security of your account credentials, including passwords and API keys.
• All activities that occur under your account, whether or not you have authorised them.
• Notifying us immediately of any unauthorised use of your account or any other breach of security.
• Ensuring that your use of the Service complies with all applicable local, state, and national laws and regulations.

You may not use the Service for any unlawful purpose, to transmit harmful or malicious content, or to attempt to interfere with the proper functioning of the platform.

4.1 Billing Cycle. Subscriptions are billed on a recurring monthly or annual basis, depending on the plan you select. Your subscription automatically renews at the end of each billing cycle unless cancelled before the renewal date.

4.2 Payment Methods. We accept payments through UPI, net banking, credit/debit cards, and other payment methods supported by our payment gateway partners. All prices are listed in Indian Rupees (₹) and are inclusive of applicable GST unless stated otherwise.

4.3 Failed Payments. If a payment fails, we will attempt to process it again. If the payment remains unsuccessful after multiple attempts, your account may be downgraded or suspended until the outstanding balance is settled.

4.4 Refunds. Refund requests are handled in accordance with our Refund Policy. We generally do not offer refunds for partial subscription periods or add-on purchases, except where required by applicable law.

4.5 Price Changes. We reserve the right to change subscription pricing. Any price changes will take effect at the start of the next billing cycle following at least 30 days' notice via email or in-app notification.

All content, features, functionality, software, designs, trademarks, logos, and intellectual property associated with the Bhojone platform are owned by or licensed to Bhojone and are protected under Indian and international copyright, trademark, and intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, and revocable licence to use the Service for your internal business operations. You may not:

• Copy, modify, distribute, sell, or lease any part of the Service or its source code.
• Reverse-engineer, decompile, or disassemble the software.
• Use our brand name, logos, or trademarks without prior written permission.
• Sub-license or transfer your right to use the Service to a third party.

You retain ownership of any data you upload or create using the Service (e.g., menus, customer records, invoices). By using the Service, you grant us a limited licence to process and store this data solely for the purpose of providing the Service to you.

To the maximum extent permitted by applicable law:

7.1 By You. You may cancel your subscription and terminate your account at any time from within the app settings or by contacting our support team. Cancellation takes effect at the end of the current billing period; you will continue to have access until then.

7.2 By Us. We reserve the right to suspend or terminate your account, without prior notice, if:

• You breach any provision of these Terms.
• You fail to pay subscription fees after repeated reminders.
• You engage in fraudulent, abusive, or unlawful activity using the platform.
• We are required to do so by law or regulatory order.

7.3 Effect of Termination. Upon termination, your right to use the Service ceases immediately. We will retain your data for a period of 90 days, during which you may request an export. After this period, your data may be permanently deleted.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India. Before resorting to litigation, the parties agree to attempt to resolve disputes through good-faith negotiation or mediation.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

We may revise these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes:

• We will update the "Last updated" date at the top of this page.
• We will notify you via email or an in-app notification at least 15 days before the changes take effect.
• Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
